We are committed to conduct our business in an ethical way and in full compliance with applicable laws and regulations. We believe that how we conduct ourselves is as critical to our success as developing excellent products and services. Our Business Conduct and Compliance policies are foundational to how we do business and how we put our values into practice everyday.

With the implementation of the corporate liability provision under Section 17A of the Malaysian Anti-Corruption Commission Act 2019 (Amendment 2018) in June 2020, the Group has taken the initiative to further strengthen its corporate governance by acquiring the ISO 37001:2016 Anti-Bribery Management System (ABMS) certification from SIRIM QAS International Sdn Bhd.

As recommended by the Primes Minister’s Department, we have introduced several policies and procedures, including the Anti-Bribery and Anti-Corruption (ABAC) Policy and Procedures, Whistleblowing Policy and Procedures, and the Code of Conduct and Ethics, which are mandatory for all our employees and business partners.

 

Section 17A MACC Act

Commercial organization commits an offence if a person associated with commercial organization “gives, agrees to give, promise or offers to any person” any gratification;

Company directors and senior management will be held personally liable for acts of corruption committed by the company, either by their own personnel or by parties acting on behalf the organization;

Penalties include fines min RM1 Million and/or 10 times (whichever is higher) and prison sentences of up to 20 years for those in charge of the business;

Companies which have been proactive in preventing corruption occurring can present the defence of having “adequate procedures” in place, to prove the necessary measures were taken to prevent the incident occurring and therefore those in charge should not be held liable.

 

Whistleblowing

The Whistleblowing Policy is a platform for the public or Puncak Tegap’s employees to report any violations or potential violations of ethics and integrity within the organization. If you witness any type of violations listed below, speak up!

No Gift Policy

Puncak Tegap aspires to achieve the highest standards of integrity and ethics in the conduct of its business and operations.

We practice a “No Gift Policy” where our employees are prohibited from exchanging gifts in any form in their dealings with third parties such as stakeholders, partners, vendors and the general public.

This policy helps us to maintain ethical work and business relationships and meant to avoid any conflicts of interest or the appearance of conflicts in any ongoing or potential business dealings of Puncak Tegap.
